Guinness PRO14 Fantasy Rugby 2019-20 - Terms and Conditions

The following Terms and Conditions constitute an agreement between the Entrants, the Game Operator and the Promoter.

It is important that Entrants read them carefully and understand what they mean. By entering into the Game, Entrants confirm their complete understanding and acceptance of these Terms and Conditions.

Definitions

In these Terms and Conditions:

'Game' means the Guinness PRO14 Fantasy Rugby 2019-20 game which will run on the Website.

'Game Operator' means onSport Limited, a company registered in England and Wales number 09150260 and registered address 3a Lloyds Wharf, 3 Mill Street, London, SE1 2BD.

'Materials' means the text, graphics, photographs, pictures, sounds, digital audio and video clips published on the Website to publicise the Game.

'Players' means the rugby players currently participating for a club in the Guiness PRO14 2019/20 season.

'Promoter' means Celtic Rugby DAC, of 3rd Floor, Millbank House, Arkle Road, Sandyford Industrial Estate, Dublin 18, Republic of Ireland.

'Entrant/Entrants' means any person/persons who make an entry into the Game.

'Website' means the following website:

fantasy.pro14rugby.org

and/or any other websites or publications as deemed appropriate by the Promoter and notified to Entrants from time to time.

1. Eligibility

1.1 Minimum Age

Entrants must be 18 years of age or over on the date of entry into the Game. Failure to observe this will deem any winning entry invalid and prizes will be forfeited.

The Promoter reserves the right to require Entrants to provide proof to verify eligibility.

1.2 Territory

The Game is open only to users resident in the United Kingdom, Ireland, South Africa and France. Each Entrant must ensure that his or her participation in the Game is lawful in accordance with the laws of the country of which he or she is a citizen and/or resides, and/or happens to be at the time his or her entry is made. Neither the Promoter, the Game Operator nor their respective servants or agents shall be taken to make any representations, express or implied, as to the lawfulness of any Entrant's participation.

1.3 Others

Employees of the Promoter, the Game Operator, their respective group companies, agents, and members of their families or households may enter the Game but will NOT be eligible to win or receive prizes.

2. The Game

2.1 Duration

The Game will run from November 25th 2019 until the final round of PRO14 fixtures on May 29th 2020 (the 'Game Period'.

2.2 Entry

Go to the website and follow the onscreen instructions. Entrants' entries are free of charge. Entries (and any subsequent changes i.e. transfers) must be made manually by the Entrant via the online form available on the Website. Any use of automated processes to take part in this Game is forbidden, and any Entrant suspected of using automated processes may have their teams deleted. This is at the discretion of the Promoter, and the decision of the Promoter is final.

Entries can be made at any time during the tournament the Game Period, however Entries must be received prior to a round (in accordance with the deadlines as set out in section 4.3 below) to be able to receive points for such a round. Entries received after a round deadline will begin scoring from the next round. No Player points will be backdated.

2.3 Teams

The Game is limited to one team per Entrant. The Promoter reserves the right to reject any team/entry name that it considers to be inappropriate or offensive. In such an event, the Promoter will automatically apply another team name.

The Game computer's record of an entry will be regarded as the entry itself. The Promoter will not be held responsible for entries lost or distorted in transfer. Proof of magnetic transcript is not accepted as proof of entry.

2.4 Eligible Matches

Eligible matches for the Game are all games in the Guinness PRO14 2019/20 season, Round 7 to Round 21. The Promoter reserves the right to include matches beyond the final series and therefore the eligible matches are subject to change.

2.5 Notifications

The Promoter may from time to time offer Entrants discounts and special promotions at its sole discretion. To qualify for discounts and special promotions online Entrants must comply with the offer conditions.

Eligible matches for the Game are all games in the Guinness PRO14 2019/20 season, Round 7 to Round 21. The Promoter reserves the right to include matches beyond the final series and therefore the eligible matches are subject to change.

2.6 Final Decision

If the Promoter believes at any time that, in their sole opinion, a single Entrant has made more than one registration for a team then we reserve the right to remove all, or some, of those Entrants and entries from the Game or make them ineligible for prizes. The Promoter's decision regarding the exclusion of teams will be final and no correspondence relating to such exclusions will be entered into.

3. Picking Your Team

3.1 Team Selection

Entrants may only select one team for the competition - multiple teams will be deleted.

Each team entered into the Game must consist of 9 Players.

Entrants may only select for its team a maximum of three Players from any one club during the Guinness PRO14 2019/20 season at any one time.

3.2 Player Selection List

Only Players included in the official Game selection list found on the website may be included in a team and a Player cannot appear in the same team more than once at any one time. Player values are arbitrarily allocated for the purpose of the Game and the Promoter will not enter into any correspondence regarding Player valuations.

3.3 Formations

Only the positions allocated to Players in the official Game selection list found on the website will apply to the Game and the Promoter will not enter into any correspondence regarding Playing positions allocated for the purpose of the Game.

    Your fantasy team must include:

    • Five (5) x Backs

    • Three (3) x Forwards

    • One (1) x Kicker

3.4 Team Defence

Based on defensive statistics, Entrants must also select a Pro14 club that will have the best defence from the weekends round of fixtures. Please see Scoring below for the breakdown of points allocation.

Alternatively, Entrants may choose to utilise the 'Auto Select' feature in which case the Game computer will randomly select an eligible team which will be shown on the screen.

3.5 Budget

You have an unlimited budget to select your 9 players in this year's Game.

4. Scoring Points in the Game

4.1 Points

Based on their performance, Players will be allocated points score after each game. Actions occurring in extra time count but penalty shoot-outs do not. Points are awarded as detailed in the table below:

The Man of the Match bonus points are awarded in line with the PRO14 Rugby's official decision.

The allocated points for each Player will be published on the Website after each round.

The points for the Team Defence takes into account the following game statistics from the fixture: Win Match, Bonus Point Loss, Points Conceded, Team Turnovers & Missed Tackles.

The Promoter will not enter into any correspondence relating to the allocation of points to Players. We accept no responsibility for the accuracy of this data.

4.2 Assists

The Player providing the 'last pass' before a try is scored is awarded three points for an assist. This can only be in the form of a thrown pass or a kick by a member of the same team, which reaches the try scorer without significant intervention from a member of the opposing team. No assist will be awarded for a pushover try directly from a scrum, or indeed any situation where there is not an obvious 'last pass'. Hence, there is also no assist if the try scorer picks up the ball from the ground or directly from the hands of a team-mate. An assist will only be awarded for a penalty try if a try is prevented due to an offence on an individual Player to prevent a try, in which case the Player fouled will gain the assist. In all cases, the decision of the Promoter is final.

4.3 Deadlines

The PRO14 2019/20 round deadlines are detailed on the 'Rules and FAQs Page'. These dates are subject to change depending on the fixture schedule.

Any transfers or Kicker changes made after each PRO14 2019/20 round deadline will become active at the next round.

Teams entered after each PRO14the round deadline will not score points for that round.

4.4 Kicker

Entrants must nominate a member of their team to be Kicker. This Player will be the only player in the team who will score points for penalties and conversions. If the Kicker does not play then the points will be lost. Another Player will not take over the Kicker role in their place.

4.5 Transfers

New to this year's Game, due to a new emphasis on weekly points - you will have a season long transfer amnesty.

This means you will be able to make unlimited changes to your team week to week to give you the best chance to come out on top!

You can switch your designated Kicker as many times as you like before the start of each round.

The transfer window will shut at each round deadline, and will re-open shortly after the conclusion of each round.

Transfers can be made online only on the official Guinness PRO14 Fantasy Rugby Website. Entrants may use the transfers page to change their team for the next round.

5. Leagues

5.1 Leagues

Each Entrant competes and is automatically entered into the following leagues.

  1. The Overall League
  2. Monthly Prize League
  3. A league for supporters of your favourite team
  4. Each Entrant may also choose to enter into or create private leagues with friends and colleagues. Private leagues are joined at the Entrants discretion and are not compulsory.

In all leagues, teams are ranked based on the total points accumulated in the Game.

6. Prizes

Round Winner

Every First (1st) Place Winner for each game round from Round 7 to Round 21 (inclusive) will recieve TWO (2) x Tickets to Pro14 Final thanks to Guinness PRO14 Fantasy Rugby 19-20.

Prizes are subject to availability and there is no cash alternative available for the prizes

For the avoidance of doubt, there are no prizes awarded by the Promoter for any private leagues or the league for supporters of your favourite team.

6.2 The Overall League Winner

The winner of the Overall league will be the Entrant whose team accumulates the most points over the matches played during the Guinness PRO14 2019/20 season.

6.3 The Monthly Prize League Winners

The winner of the Monthly Prize League will be the Entrant whose team accumulates the most points over the matches played during the given monthly breakdown. The prize will be awarded to the Entrant whose team has amassed the highest number of points after all the matches within this range are complete.

6.4 Weekly Prize

There will also be a prize available each week for the Entrant whose team accumulates the most points over the matches played during such week. Details to be confirmed

6.5 Tiebreak

In the event of a tie between teams at the end of either the entire Game Period or at the end of each monthly period (as applicable), the team which has registered the most tries during the Game Period or the monthly period (as applicable) will be positioned higher. If a tie still remains, the team which has registered the most assists during the Game Period or the monthly period (as applicable) will be positioned higher, followed by the most clean sheets registered. In the unlikely event that teams still remain tied at this stage, the team that was entered in the Game first will be named the winner.

7. General

7.1 Notification of Winnings

Winners will be notified via e-mail and prizes will be sent out within 28 days of the prize being verified by the Promoter.

If the Promoter has been unable to contact the winner of any prize within 14 days of that prize period ending, the prize will be awarded to the Entrant of the next highest scoring eligible team in such prize period.

Winner's surnames and country/county of residence may also appear on the Website the day after each prize period is completed. Winners have the right to object to this information being published or made available – in such event they should inform the Promoter in writing. In such circumstances, Entrants acknowledge that the Promoter must nevertheless still provide the information and winning entry to the ASA or equivalent regulator on request.

The decision of the Promoter will be final in all matters relating to the awarding of Game prizes and no correspondence will be entered into under any circumstance.

7.2 Data

All personal data submitted in connection with the Game will be processed for the purposes of administering and managing the Game and prizes (where applicable) and verifying the eligibility of each Entrant. The Promoter is committed to protecting the privacy of all Entrants. Data that is collected from or about Entrants will be used in accordance with the Promoter's Privacy Policy, a copy of which can be found at https://www.pro14rugby.org/legal/.

8. Miscellaneous

8.1 No Liability

The Game Operator and the Promoter have made all reasonable endeavours to ensure that the Game is provided using reasonable skill and care. However, to the fullest extent permitted by law, no warranties are made whatsoever in relation to the accuracy, suitability, reliability, completeness or otherwise of the Game itself nor in relation to disruptions, delays or errors in connection with the Website or the internet, in particular for any acts or omissions made by any telecommunications service provider with whom you have contracted to gain access to the Website, all to which without limitation the Game Operator and the Promoter shall not be held responsible. Further, no warranty is made in respect of information to which you may have access but which has not been directly provided by the Game Operator and/or the Promoter, including without limitation, information on the internet available outside of the Website which shall remain the responsibility of the provider of such information. Your statutory rights are not affected.

8.2 Limitation of Liability

Except as expressly provided in these Terms and Conditions, and to the fullest extent permitted by law, the Promoter, the Games Operator and their respective employees, agents and partners disclaim any and all liability in respect of any loss or damage arising out of the Game and/or Website, whether such loss or damage results from negligence, breach of statutory duty or otherwise, and whether in contract or in tort or otherwise, including but not limited to the loss or corruption of data, any errors or omissions, content, delays or interruptions in transmission or operation and lines or communication failure. In no event shall the Game Operator and/or the Promoter be liable for any business losses or any losses caused by force majeure (as further described below).

In the event that any liability does arise then the liability of the Promoter and the Game Operator whether in contract, tort or at law shall be limited in aggregate to the sum of £100.

8.3 Intellectual Property

Without limitation, all of the Game Materials and content on the Website is the exclusive property of the Promoter and/or of the companies who may have supplied such Materials to the Promoter. The Material, including compilation, selection, presentation and arrangement thereof, is protected by national laws and international agreements on copyright, moral rights and other intellectual property rights. All promotional and explanatory material on the Website form part of the Terms and Conditions. Entrants may not modify, reproduce, distribute, exchange, sell or transmit any of the Material, nor store it in any form (whether tangible or electronic). Copying or downloading the Material for any business, commercial or public purpose is strictly forbidden. Civil or criminal liability may result from any use in contravention of this clause. The Game's name and logo, and any other graphics, logos and trademarks used on the Website are protected by laws and international agreements on intellectual property. None of the trademarks may be used in association with the products or services of a third party or in a manner which could, either directly or indirectly, defame or discredit us or a third party. All trademarks and trade names appearing on the Website (including names or products belonging to third parties) remain entirely the intellectual property of the Game Operator or the Promoter or the intellectual property of their respective owners (as the case may be).

8.4 Changes in Terms and Conditions

The Promoter reserves the right to withdraw, alter or suspend the Game or these Terms and Conditions at any time if circumstances beyond its control make this unavoidable.

8.5 Force Majeure

The Promoter shall not be liable for its failure fully to perform their obligations under this Agreement if and to the extent that such failure is due to reasons of force majeure or change in laws or regulations or any other occurrence beyond either party's reasonable control.

8.6 Governing Law

a) These Terms and Conditions relating to the Game and how it's played, managed and prizes awarded shall be governed by and interpreted in accordance with English law.

b) If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident (provided it is one of the eligible countries described in the 'Territory' section, above). Nothing in these Terms and Conditions, including the clause above, affects your rights as a consumer to rely on such mandatory provisions of local law.

c) The parties submit any disputes arising under or in relation to these Terms and Conditions to the jurisdiction of the courts of England and Wales. However, if you are a European Union consumer, you can also bring legal proceedings in the courts of your country of residence (provided it is one of the eligible countries described in the 'Territory' section, above).
